This is my attempt at an evil smiter, to play the new area Elysium with. Feel free to critique and comment as I'm sure there is room to be improved. Skills?
I would suggest boosting concentration for Elysium. Looks like you are gonna be able to max 5 skills with this build. So, disc, tumble, taunt?, conc, craft armor?

I messed around with quite a few CC BG builds when I got Pharlan and wanted to finaly make a smiter. After chatting with a number of mates on this issue I came to realize that a non quasi cc BG feels like the little guy in the locker room comepared to other smiters. There is just no reason atm to go cc BG over a Lash or Bane Knight unless you want to use a 2 handed weapon and get the shield AC from divine shield.
Unless something has changed recently that I am not aware of, this is still true. As I said its been a while since I have dove into smiter builds after settling on a CoT.
Why did you choose this build over a Lash or Bane Knight?

I actually have a Pharlan Bane Knight at level 37 and it's really fun. I never liked playing a lash so I scrapped it. I wanted to make a BG Smiter just for the fact that I can play it for fun in Elysium and Rona, with some decent damage. Neg Smites and Smite Good plus tanking ability for Elysium could be really fun to play around with.
What is nice about CC BG Smiters is that CoT, Pally, and BG all add to the smiting level so I have a full 60 level for smiting.
I forgot about Div Shield AC with 2 handers...will look into it as this build has a base 30 charisma at 60.
- Divine Shield now grants +(Cha modifier / 2) Shield AC if your control class is blackguard or paladin, you have no monk levels, and you do not belong to a quasiclass.
Found that, so 30 + 12 = 46....18 modifier. 18 Shield AC with div shield.

Actually, thats 9 AC, it's charisma mod/2. About the build... I do NOT think that having a dex of 8 is a good idea for an elysium build, the movanics will have you on your knees pretty much all the time. Also, epic toughness on 39 is a complete waste, if you shuffle around your feats, you can take prowess then (assuming a BG feat), and take something more useful on 21, or possibly shift progression to 8/28/4, which is down a feat, but gives you 4 more smiting and casting levels, as well as 1d6 more sneaks.

I do get more casting levels, but my smiting levels would be the same (CC BG gets Pal + CoT + BG) and the reason for epic toughness was literally nothing better, same with the summon. Will look into reshuffling. I will see what 8/28/4 will get me feat wise. As for 8 Dex, I am open to suggestions as to where I would get the stat points

You could lower charisma to 14(18), and raise dexterity to 12, then, replace 21 and 24 with great-charismas, and put prowess and armor skin in place of fiend and epic toughness, you can do that since they're epic CoT an Blackguard feats. I might actually be tempted to lower INT by 2 to get dex to 14, considering movanics are SUCH a pain, but you would have to reshuffle your skills.

Thats a good point t1k. Seems an optimal party for Elysium is looking something like this atm:
1. Demi Caster Bard with Rod of Asmodeus* (dex Bard would also rock as I think the caster bard would run out of ring rests while trying to keep UUU going so much) 2. NB Druid** 3. Assassin - Only one, for the trushes and animals on the run. 4. Wizard - for hands, mf's, ED and weirds. 5. Uni tank - Disarmer *** 6. Uni tank - Damage dealer 7. Uni tank - Damage dealer 8. Dev Crit AA - Damage dealer 9. Battlecleric - for big area BT and and damage dealing
Last place for either Cleric (prayer and implosions) or Turner (crowd control and prayer)
