You can change the order of classes a little to reduce the XP penalty. Take the third level of fighter at 6 and the eighth level of Rogue at 21. The feats will stay the same and you can do a tumble dump at 21 for better AC as epic.
If you want to move the first DD level earlier, you can take rogue 7 at 20, fighter 4 at 21 (with the earlier epic weapon focus) and hold off on rogue 8 until about 30 for another tumble dump and I think you'll get some of the dev crits earlier (or maybe not, optomize it for yourself).
This gets the same feats and levels by level 40 as the original but I think it is a bit easier to play getting up there.

I always thought xp penalties hit as soon as you had one class out of range - and how much it was out of range did not matter. It gets worse the more you're out of sync with classes, with the exception of prestige and favored classes.

I always thought xp penalties hit as soon as you had one class out of range - and how much it was out of range did not matter. It gets worse the more you're out of sync with classes, with the exception of prestige and favored classes. If you take the Rogue at level 6, you get an immediate XP penalty. If you take Fighter at 6, you don't get the XP penalty until 8. It's not a big help, but it eliminates the penalty for two levels.

Well I got this character to 60 without noticing the XP penalty so I wouldn't fret too much over it.
I'm tagged 2 levels into hell. So far I've found the build in Hell to be very stable. I ran YAL and checked my performance. On my last Dispater run I was in the top 3 for damage output which was nice (used a dustbone dwarven waraxe). My AC is 132 and my AB after buffs hits 102.
If I were to reincarnate I might focus less on Saves. But we'll see after I reach the deeper layers of hell before I make that call. My last dispater run I only failed about 6 out of 100 saves. Of those 6... 5 were "1"s which will fail regardless. 1 was a constitution check where I rolled a 4 and failed the check. So my saves so far are really overkill. Again... we'll have to see what the lower hells are like. Since I'm 60 now those saves are not going to get any better... and the lower levels will be harder.
The sneak attacks i get from rogue levels really paid off. It makes a real impact on my phsyical damage output. I was surprised to find that quite a few mobs out there are not sneak immune.
I'm really happy with this build as is. It worked out quite well and I would encourage any new player to use it if they like playing strength tanks. This one gets the job done.
(to be fair... my char is now a battlerager UR subrace, but its not that dramatic an increase in power from the open subraces)

Just noticed this build was still listed on the wiki. Sweet.
I plan to revisit him someday soon. He's my highest character in my toolbox, I hear DD's are not so common as tanks these days... but I had fun with him so I'm going to dust him off after his proxy is done tagging the pre LL tags.
