If you use the spell penetration tome then there is no need to take spell penetration and greater spell penetration, that's a waste of two feats. I did not realize that. Thanks for pointing that out. So if I get Epic Spell Penetration from the Tome I will automatically be at +6 without having to work in SP and GSP? Awesome! Exactly, then you could move two of your toughness feats from legendary levels to epic levels and take Epic Spell Focus: Evocation and Legendary Spell Focus: Evocation if you wanted them.

The Sound Orbs will be at CL 18 as they are not DSM spells to my knowledge and I would never drop any DSM spells. I would swap on my list Acid Sheath for Stone to Flesh I was going through the spells quick and over looked that one.
Yes with the Tomes you get the same bonus as if you earn Epic Focus or Penetration so taking those 2 feats would be redundant. Yes your Wing Buffet will be better then CL 18 Gust so do not pick up Gust.

Okay, I have updated for Spell Penetration.
I decided to keep Persuade, for the additional -6 to Penetration when needed.
I went with most of the spell changes, but decided to go with Globes of Sound rather than Globes of Electricity to give me a more diverse damage base. At level 1 I kept the Minor Globe of Electricity over Indentify. With my Lore maxed, I rarely need to identify an item.
I decided to go with Death Armor over Ghostly Visage or False Life. I can cast Ghostly Visage from Greater Shadow Conjuration and I have plenty of Hit Points in this build. I already have Elemental Shield and Mestil's Acid Sheath, so why not be THAT GUY?
I decided to go with Flesh to Stone (level 6 spell) rather than Ethereal Visage, as I already have more effective physical immunity from Stoneskin, 50% concealment from Improved Invisibility and can use Greater Shadow Conjuration for Minor Globe of Invulnerability to get immunity to spells level 1-3.
I decided to keep Shadow Conjuration simply because it is 4 spells in 1 for what is already a garbage slot.

I agree completely if the Globes of Sound are not DSM spells, but they are currently listed as such under the Quasi-Class Documentation; "Spells - Some spells, listed below, use Sorcerer level + Blue Dragon Disciple level (including legendary levels if the character's control class is Sorcerer or Blue Dragon Disciple) to calculate caster levels. In addition, all these spells count as Evocation for determining DCs, and receive +1 spell penetration for every 10 caster levels over 20. The caster may add half their caster level to their Lore skill for casting DSM spells. I pulled from here but the best thing to do is test in game and ask some of the vets also since I assume your running HGE look at the spell descriptions in game and see if they label it as a DSM spell. I did test and Great Thunder Clap does Sonic damage so there is one source of alternative damage I would have to look over my spell choices again a little if Sound Orb is a DSM spell but it would still change very little.

Good thing you guys are bit faster on the uptake than I am... And yeah, sorry for not mentioning that you can get a Spell Penetration book as well in the PM. Didn't intend to lead you astray. ;D

Thanks for all the help guys. I am really blown away by all the helpful feedback. This was sort of a longshot build but I really wanted to do something that hadn't been done before, and all the feedback has really helped shape this build into something that will hopefully be playable at all levels. I will continue the field testing. Thanks again!

Not sure if that was a typo or not, but just make sure you take Flesh to Stone[/] - it's the one that will free petrified party members (pretty common in desert & db runs).

Just a note as a BFM/DSM you get +1 Spell Penetration for every 10 CL after 20 so you get +3 SP I might drop LSP for LSF Evocation to boost DC as you have improved SP as a class benefit. Ideally you pick up both but that is just my rationing between which is better to pick up if you have to choose.

I would check displacement. BFMs get decent duration on displacement, I would guess it's a DSM spell as well. Great Thunderclap is great for damage at end game, but the stun effects aren't as useful. Extend is nice if you are able to fit it in, but my str bfm is probably my tightest feat build out of 15.
