You're only looking at it from the PvP perspective, and my main concern is PvM. 45 sr was a fart in the wind to LL area enemies, but 65, or even a good bit lower, would not be. THEY already had casterlevels added to penetration, and have been unchanged by the edit for PCs. Subrace sr's were designed around a no-increase-after-40 mold, so that their importance in the upper levels was highly diluted. Upping PC sr's is therefore balance altering, in the extreme. What I'll do about it is another question, and depends on how much tinkering I would have to do with monsters. There's also the related issue that increasing those subrace sr's puts them in contention with monk sr, and past it, and while I DO intend to increase monk sr, doing so in the same degree for subraces would vastly increase the power of some, and remove much of the monk's uniqueness, unless I am very careful. I was going to ask about that subrace thing, being drow, but it seems its already been brought up.
Next questions then, are...are LLs going to be taken into consideration for summoned familiars? (Probably more trouble than its worth, with the legions of lockpicks with wings out there)
Also...I know you haven't touched the special-epic spells yet, but I would recommend it when you get a chance. This is mainly because Missle Barrage is now useless, in that it has a 48 Spell Pen attached to it, reflecting level 40 +8 for LL penetration. It is also the only epic to have penetration attached to it.
As a bug also though, Missle Barraged is blocked by Death of Magic, and the Death of Magic description states that only epic spells work while DOM is up - which isn't true, since greater ruin fizzles just like missle barrage, but starfire works...something there may not be right.
And it's no secret that I want to see Starfire uncapped for level 60...as it is, the book says it goes up by caster level, and in function it does - both DC and damage rise to level 40.
I was thus curious...are you planning on altering the super-epics for level 40 also?

Sorry if I missed this somewhere but is there a consideration to enhance Shadow Evade (for shadow dancers) and also Improved Invis (for assassins) in legendary levels?
The reason I mention this is that these 2 classes now fall behind Etheral Visage casters such as Bard in terms of concealment.
Not sure if monk should be or are intended to be comparable to shadow dancers and assassins for concealment.

Is there something wrong with how DoM works vs Epic spells and Super-Epics? Description states that only epic spells work under DoM, but G-Ruin and Missle Barrage both fizzle, yet Starfire works. I'd expect that Balor works, and Hellball/Warding both fizzle also, but I'll have to test that.

And should these spells like Missle Barrarge be blocked by SR? and if so maybe as part of the Level 60 update, after a certain level they cannot be stoppped by SR?

They will always bew stopped by high enough sr, but they currently do not scale for LL penetration, and they will once updated. Funky
